Step 2: We will email you a link to the recording with a reporting form.
Step 3: Watch the recording and listen for 2 unique keywords. Complete the reporting form and be sure to include the two keywords and the date/time you watched the recording. Then submit the form.
Step 4: Shortly after, we will email your MCLE certificate.

Representing young people as plaintiffs in social justice litigation is a collaboration crucial to protecting and advancing their rights. It can also raise a host of confusing questions: When do courts require that youth be represented through adult guardians? What are the differences in attorneys’ obligations to youth plaintiffs versus guardians? What should attorney-client communications look like? How do case decisions get made? Are there any special protections regarding potential discovery and trial testimony? This training will dive into those questions and offer guidance on how to approach litigation involving youth plaintiffs.

In Trump v. CASA, Inc., the Supreme Court held that federal courts do not have the authority under the Judiciary Act to issue nationwide injunctive relief unless necessary to provide complete relief to the plaintiffs. Federal courts can, however, order widespread injunctive relief to plaintiff classes that meet the requirements of Rule 23(b)(2). Join us for a training on the mechanics of litigating a Rule 23(b)(2) class action, as well as strategy considerations specific to the post-CASA landscape. We will reserve the final 30 minutes for questions and discussion.
The Impact Fund supports impact litigation on behalf of communities seeking economic, environmental, racial, and social justice by maintaining an active docket of class and other impact cases, writing amicus briefs on an array of class-related issues, providing grants to support class and other impact cases, and training public interest litigators on class-action strategy and other topics.

We will review how to provide culturally competent and meaningful language access for clients with limited English proficiency and effective communication for people with disabilities, identify when a certified interpreter or translator is required, provide a primer on commonly used assistive technologies, and explain the scenarios when you may rely on AI translation tools.

A racial impact assessment is an examination of how different marginalized groups will likely be affected by a proposed action or decision. It is intended to minimize unanticipated adverse consequences of proposed litigation on affected communities or groups. We will explore critical questions and processes to identify stakeholders, challenge default decision making and litigation strategy, and uncover inequities that may arise at any point from investigation to the conclusion of the case. This training will take a deep dive and encourage public interest litigators to incorporate this inquiry when litigating for social change.

While civil litigation is often contentious, opposing counsel demonstrating a lack of respect for attorneys coming from underrepresented groups in the law is a particular challenge. We will discuss common issues that attorneys experience with opposing counsel particularly based on sex, gender, and intersecting identities, provide strategies to combat discrimination at every stage of civil litigation, and review the guidelines that prohibit this conduct in the legal profession.
