


Injunctive Relief Class Actions after Trump v. CASA, Inc.: Navigating Rule 23(b)(2) for Impact Litigators

In Trump v. CASA, Inc., 145 S. Ct. 2540 (2025), the Supreme Court held that federal courts do not have the authority to issue nationwide injunctive relief. Federal courts can, however, order widespread injunctive relief to plaintiff classes that meet the requirements of Rule 23(b)(2) of the Federal Rules of Civil Procedure. Join us for a training on the mechanics of litigating a Rule 23(b)(2) class action, as well as strategy considerations specific to the post-CASA landscape. We will reserve the final 30 minutes for questions and discussion.
The Impact Fund supports impact litigation on behalf of communities seeking economic, environmental, racial, and social justice by maintaining an active docket of class and other impact cases, writing amicus briefs on an array of class-related issues, providing grants to support class and other impact cases, and training public interest litigators on class-action strategy and other topics.
