Impact Fund Statement on Recent Supreme Court Decisions

June 30, 2026 – Today's Supreme Court decisions reflect both the promise and the fragility of our constitutional democracy. In its final decisions of the term, the Court struck down the executive order that sought to end birthright citizenship, affirming that the Fourteenth Amendment guarantees citizenship to nearly everyone born on U.S. soil. In two other rulings, the justices held that states may bar transgender students from girls' and women's school sports, and they lifted decades-old limits on how much political parties can spend in coordination with their candidates.

In response, Impact Fund Executive Director Lindsay Nako issued the following statement:

"The Court's decision reaffirming birthright citizenship is a welcome reminder that the Constitution protects fundamental rights and cannot be erased by executive action. The Constitution is clear: If you’re born here, you belong here. On the very same day, however, the Court moved us further away from the Constitution's promise of equal protection by letting states bar transgender students from school sports and giving money still more power over our elections."

"Today's decisions underscore why the work of impact litigation remains so essential. The courts continue to be one of the most important places where rights are won or lost. Impact Fund will continue supporting the advocates and organizations working to ensure that our legal system remains meaningful for everyone, not only those with wealth and power."
