In 1996, the 104th Congress prohibited Legal Services Corporation (“LSC”) grant recipients from initiating or participating in class action suits. Class actions also can be resource-intensive, expensive, and prolonged. As a result, many direct services providers have focused their efforts on impact litigation, cases brought on behalf of one or a few plaintiffs with the potential to bring significant change to others. In this presentation, Jocelyn Larkin and Lindsay Nako will walk through the steps of identifying impact cases, selecting plaintiffs, framing claims, and maximizing litigation for its greatest benefit.
